High Court pulls up State, doctors

The Karnataka High Court on Wednesday took the State
government to task for failing to invoke Essential Services
Maintenance Act (ESMA) against government doctors to
prevent them from going on strike and also for failing to
make alternative arrangements for patients in advance.
The court also said that doctors on government duty cannot
go on strike and they would have to approach legal forums
such as the courts for getting their grievances redressed if
the government failed to honour their reasonable demands.
Normality
A Division Bench comprising Justice K.L. Manjunath and
Justice Ravi Malimath made these observations orally after
government counsel told the Bench that services in
government hospitals had returned to normality as doctors
reported back to duty on Wednesday and they would work
for a month though many of them had submitted their
resignation.
The Bench, which was hearing a public interest litigation
petition filed by N.P Amrutesh against doctors’ strike, also
asked the State to file its statements while asking the
president of the Karnataka Medical Officers’ Association to
be present in the court on Thursday.
The Bench asked the counsel why the government did not
invoke ESMA against the doctors when the High Court had
issued specific directions in 2005 and 2009 when a group of
doctors went on strike then. “Why can’t we take up
contempt of court case suo motu against the government
for not following directions issued in 2005 and 2009,” the
Bench asked government counsel.
When it was pointed out that two persons died on Tuesday
due to “non-availability of doctors” in different government
hospitals, the Bench asked why the government did not act
when it was fully aware of the demands of the doctors more
than three months ago.
What alternative arrangements were made by the
government at its hospitals when the association issued
notice one month ago about the strike and indicating that
they would resign en masse, the Bench questioned. “You
should have accepted their resignation and made alternative
arrangements,” the Bench observed.
‘Drama’
“It is the third time this kind of drama is happening in the
State with doctors going on strike. Why you did not act
timely despite previous directions from the High Court,” the
Bench asked while adjourning the hearing till Thursday.

Karnataka govt keen to constitute 7th
pay commission for govt employees
MYSORE: Chief minister Siddaramaiah on Friday said that
the state government is positively inclined to constitute
seventh pay commission for state government employees
in addition to providing various facilities to them on the
lines of central government.
Addressing state level government employees conference
here, he said the employees are demanding the
government to constitute new pay commission, but you
should know that state government has implemented the
recommendations of the sixth pay commission in 2012
and there is time till 2017 for constitution of the new pay
commission.
As there is pressure from the experts to prepare from now
itself to constitute the new pay commission government is
working in that direction, he said adding that soon the
state government may come out with a decision on the
constitution of new pay commission. "However we are
determined to provide facilities to the state employees on
the lines of central government," he said.
Speaking for more than one hour at this state level
conference being organized after a gap of six years, that
too at CM's homeground, he said government is timely
releasing the allowances and salaries of the employees.
Referring to the demands of the government employees,
chief minister said at the same time the employees should
learn to work sincerely with a service motto. "Government
employees should realize their responsibilities and duties"
he said urging the workers to discharge their duties
properly. "I am not here to give sermons to you, but if you
want to command peoples respect you have to work
seriously and sincerely," he added.
Suggesting the employees to hold this conference once in
every three years, Siddaramaiah said such conference will
instill confidence you and make you to rededicate yourself
for a public cause.
Releasing a souvenir on the occasion, housing minister
Ambarish said the employees are the link between the
government and people and is the responsibility of the
workers to make the government programmes reach
people. "This will happen only when employees realize
that this itself is a great work and needs dedication," he
said.

BANGALORE: The new transfer guidelines of the state government reducing the minimum tenure of Group ‘A’ and ‘B’ officers to just one year and fixing the minimum tenure of three years for transfer of ‘C’ group employees has not only added to the woes of the employees, but also helped the ‘transfer business’ to thrive.Amid serious objections from the employees and officials, the state government has reduced the maximum limit on transfers in any cadre from the earlier five per cent to three per cent to assuage their resentment.However, the reduction of minimum tenure to just one year for Group ‘A’ and ‘B’ officials has raised questions about real intentions of the government. “This move will erode the stability and efficiency in administration. It is impossible to make any meaningful contribution to the department as he or she will be preparing for the transfer by the time the officials learn about the duties. Administration will suffer if officials are not allowed to continue in any post beyond one year,” a senior KAS officer said.“Admission of our children to new schools and finding new home every year will make our lives miserable,” an official in the Revenue Department said.Another recent move of the state government to cancel Cadre Management Authority, which used to examine the reasons for transfer of any employee, has only helped the touts and political wheeler-dealers to make some quick money. Government employees thronging Legislators’ hostel and Ministers’ chambers and residences with transfer requests or requests for cancelling transfers has become a common sight now.It is common talk in the corridors of Vidhana Soudha that rate for transfer of ‘C’ and ‘D’ group employee is anywhere between `50,000 to `1 lakh. The rate for group ‘A’ and ‘B’ officers could go up toa whopping `1 crore for posts like road transport Officers in Transport Department, sub-registrars in Revenue Department, and engineers in PWD and Irrigation departments.What is surprising is the fact that Chief Minister Siddaramaiah himself had expressed his preferencefor a minimum tenure of two years for government employees at any level just a few days before the new guidelines were issued.The Administrative Reforms Commission headed by Harnahalli Ramaswamy in its report in 2001 had recommended a minimum tenure of three years for group A and B posts, four years for ‘C’ group posts and seven years for ‘D’ group posts in the interest of better administration and controlling administrative expenditure.Law and Parliamentary Affairs Minister T B Jayachandra defended the decision when Express asked him about the adverse impact of the reduced tenure. “The impact will be very low. We have reduced the maximum transfer limit in any cadre tothree per cent from the earlier five to ensure that the transfer does not affect administration.”President of KAS Officers Association, S R Venkateshtold Express that the transfer of employees or officials is the prerogative of the state government. “The scale of inconvenience would not be much as the government has assured that the maximum limitfor transfers in any cadre will be kept below three per cent,” he added.State Government Employees Association president LByrappa said “I made a strong demand for at least three year tenure for any post. We agreed for the new guidelines only after the CM assured that transfers would be kept below 3 per cent of the cadre strength. We will wait and watch.”
